Katie Holmes filed for divorce from Tom Cruise in New York on Thursday after five years of marriage together.
According to sources close to Cruise, he was unaware that Holmes would be filing for divorce. She also filed for full legal custody of their 6-year-old daughter, Suri. Many have speculated that Tom Cruise’s deep roots to the Church of Scientology is one of the reasons for the divorce and child custody filing.
Legal sources have said that the fact the Holmes filed in New York will help her receive sole custody, even though many courts do not think that sole custody is in the best interest for the child if both parents are fit. Holmes will have to provide evidence that Cruise is an unfit parent in order to receive sole custody.
