What’s the Difference between a DUI and a DWI?
According to Texas law, a DUI and a DWI differ significantly. The following is a brief explanation of each:
- DUI – A DUI, or driving under the influence, is a class C misdemeanor. As such, the consequences are less than a DWI. They include a maximum $500 fine, community service, probation, and license suspension. First offenses carry minor consequences, but further offenses can be accompanied by jail time. DUIs apply to minors who have been drinking alcohol and driving but do not have a blood alcohol content of .08%, the legal limit for an adult.
- DWI – A DWI, or driving while intoxicated, is a class B misdemeanor which requires a minimum of 72 hours in jail. DWIs are applied to any driver who is stopped with a blood alcohol content over .08% or who is intoxicated by a controlled substance. Penalties include 1-2 years of probation, community service, license suspension, and a fine of $2,000.
